A 36-year-old Mexican immigrant, identified as David Ambrosio Herrera, was arrested by agents of U.S. Immigration and Customs Enforcement (ICE) on September 25 in Charlottesville, Virginia, shortly after leaving a state courthouse.

Ambrosio Herrera is a repeat criminal offender with a history of sexual crimes against minors and multiple illegal entries into the United States.

According to authorities, he had been convicted of sexually abusing a 15-year-old girl and had an active final deportation order.

The arrest was carried out by agents from ICE’s Harrisonburg suboffice, who intercepted him shortly after his court appearance.

Ambrosio Herrera tried to flee on foot but was captured after a brief chase through downtown Charlottesville.

His criminal history in the U.S. is extensive and remains under investigation.

“David Ambrosio Herrera is a serial undocumented offender and a convicted child sex abuser. He is exactly the kind of individual we aim to remove from the United States,” said Joseph Simon, Acting Director of ICE’s Enforcement and Removal Operations in Washington, D.C.

Three illegal entries and previous offenses

Official records show that Ambrosio Herrera first entered the U.S. illegally on April 2, 2007.

He was detained by the Border Patrol and voluntarily returned to Mexico. Three days later, he attempted to cross again and was arrested once more.

He later reentered the U.S. at an unknown date without inspection.

The immigrant accumulated multiple criminal charges in Virginia. In 2014, he was arrested for identity theft and use of false identification. In 2017, he was charged with five counts of perjury for submitting fraudulent documents.

Conviction for abusing a minor

Ambrosio Herrera’s criminal record escalated in 2024 when he was arrested in Albemarle County on charges of “abuse of authority involving a 15-year-old minor.”

He was later found guilty in 2025 and sentenced to six years in prison and two years of supervised probation.

He was also placed on the state sex offender registry.

However, the court suspended his prison sentence, a decision that has sparked criticism from groups questioning the release of offenders with serious criminal backgrounds.

David Ambrosio Herrera’s deportation process underway

Despite an immigration judge’s deportation order issued in May 2024, the immigrant remained in the U.S. until his recent arrest.

ICE confirmed that Ambrosio Herrera will remain in federal custody while his final deportation to Mexico is processed.

“He has reentered the country illegally multiple times, has a criminal record, and should never have been here to traumatize this minor,” emphasized Joseph Simon.

ICE requests public cooperation

The federal agency renewed its call for the public to report crimes committed by individuals without legal immigration status.

ICE provided its tip line — 866-DHS-2-ICE — and an anonymous online form on its official website.

The arrest of Ambrosio Herrera is part of ICE deportation Virginia operations targeting undocumented immigrants with criminal backgrounds deemed threats to public safety in the United States.

Authorities have not confirmed when he will be deported, but his removal could take place in the coming days, according to ICE’s official portal.
